TERMS & CONDITIONS

  1. General
    1. This page (collectively “the Terms”) contains the terms & conditions on which you may make use of the crative.com.au website (“the Website”).
    2. We may update the Terms from time to time and will notify such changes to you by uploading them on the Website. You should review the Terms periodically for changes.
    3. By using the Website you agree to be bound by the Terms. If you do not want to be bound by the Terms, please do not use the Website.
  2. About us
    1. Crative is the trading name of Crative, a limited company registered in Australia under the ABN 78287104454. Our registered address is 5/60 Lewisham Rd, Windsor, VIC 3181.
  3. Use of the Website
    1. Use of the Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Website without notice. We will not be liable if for any reason the Website is unavailable.
    2. Any personal data and other information provided by you is processed by us in accordance with our privacy policy, and any relevant legislation in force at the relevant time. By providing any such personal data or other information you agree to the above.
    3. If you are provided with any information as part of our security procedures, you must treat such information as confidential. We have the right to disable any user identification code or password if in our opinion you have failed to comply with any of the provisions of the Terms.
  4. Our intellectual property
    1. We are the owner or the licensee of all intellectual property rights in the Website, the material published on it, and the goods and services that we provide. That intellectual property is protected by copyright and other related laws. All such rights are reserved.
    2. You must not use any part of the materials on the Website for commercial purposes without our permission.
  5. Offer to purchase goods and services
    1. Each order you place shall be deemed to be an offer by you to purchase the goods and/or services specified within it subject to the Terms.
  6. Payment
    1. Purchases may be paid for by using a debit or credit card through our online payment facility. All prices are in Australian Dollars (AUD), and are payable in Australian Dollars. All prices are inclusive of GST.
    2. We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.
  7. Delivery times
    1. Any delivery times quoted are estimates only, based on availability and normal delivery time in working days. Crative handcrafted products and furniture are made to order and we will make and deliver them to you within 21 days from the day the order is placed. If an item is out of stock we will inform you as soon as possible and arrange an immediate full refund if payment has been taken.
  8. Charges for delivery outside of Australia
    1. If you order goods from the Website for delivery outside of Australia, they may be subject to import duties and taxes that are levied when the delivery reaches the specified destination. We have no control over these charges, and they are your sole responsibility.
  9. Returns
    1. If you wish to discuss or organise a return, exchange or refund of any item, please contact us by emailing info@crative.com.au, or by calling us on 0447904168.
    2. We endeavour to provide beautiful, carefully handcrafted products and we hope you love your new purchases. However, we offer a refund, credit or exchange where goods are faulty, have been wrongly described, are different to the product purchased on the website or doesn’t perform as advertised. We do not normally give refunds if you simply change your mind or make a wrong decision when ordering any of our products. Please read all product descriptions and choose carefully when committing to a purchase.
    3. If we find that the product has not been returned to us in fully resalable condition, Crative reserves the right to refuse a refund on the item, or deduct up to 20% of the original selling price from the refund amount.
    4. If an item you have received is damaged please inform us within 24 hrs of delivery to arrange for a replacement to be sent. In the case of faulty goods, we will reimburse you in full (the cost of the product and postage). In the case of non-faulty goods, we will reimburse you for the cost of the product only. Please ensure that these are returned unused and in their original condition (including the packaging).

  10. Cancellations
    1. If you haven’t submitted your order, simply clear the items from your shopping basket at any time by clicking the ‘Remove item’ link below the product you do not wish to purchase in you shopping basket. If you’re unsure about a product, you can check ‘Postpone’ and apply changes. This will remove the item from your basket, and place it in a ‘Postponed items’ area. If you want to place the item back into your basket, simply uncheck the ‘Postpone’ box and apply changes once again.
    2. If you have placed an order and wish to change or cancel it, please contact us as soon as you can. We’ll do our very best to make your requested changes, but we cannot guarantee that the order won’t have been processed already. If this is the case, you may have to wait until you receive the order and then follow our Returns procedure.
    3. Once we know you wish to cancel an order, Crative will refund the value of your order by cheque as we do not store any customer card details for security reasons, within 30 days of your order (provided the goods you return are in the same condition that they were when delivered to you). You’ll have to pay any charges incurred when returning the goods to Crative, unless the return is as a result of an error on our side.
    4. Hopscotch complies with the OFT’s Distance Selling Regulations. This means Hopscotch customers in the European Union that cancel their order within seven days after the day they receive their goods, and cancel the whole order, will receive a refund of the standard postage and packing costs paid as part of that order (if any). Sorry, but you will have to pay the costs of sending the order back to us. We will not refund any postage and packing charges if you cancel after the seven days allowed under the Distance Selling Regulations or if you only cancel part of your order (although you still have two weeks to return your goods per our returns and refunds policy).
  11. Links to the Website
    1. You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
    2. The Website provides links to other websites for your information. We have no control over such sites and accept no responsibility for them.
  12. Misuse of the Website
    1. You must not misuse the Website by knowingly introducing viruses, Trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Website, the server on which the Website is stored or any server, computer or database connected to the Website. You must not attack the Website via a denial-of-service attack or a distributed denial-of-service attack.
    2. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Website will cease immediately.
    3. We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of the Website or to your downloading of any material posted on it, or on any website linked to it.
  13. No waiver
    1. If we fail at any time to insist upon strict performance of any of your obligations under the Terms, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
    2. A waiver by us of any default shall not constitute a waiver of any subsequent default.
    3. No waiver by us of any of the Terms shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
  14. Severability
    1. If any of the Terms are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
  15. Entire agreement
    1. The Terms and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
  16. Force majeure
    1. Where we are prevented from or delayed in the carrying on of our business due to circumstances beyond our reasonable control, the date of delivery shall be postponed for the period that the circumstances continue.
  17. Applicable law and jurisdiction
    1. Contracts for the purchase of goods and services through the Website are governed by Australian law. Any dispute arising from, or related to, such contracts shall be subject to the jurisdiction of the courts of Australia.
